What is Conveyancing
The term Conveyancing means “the act of performing the various functions relating to the transfer of real property”.
Simply put, it is the process by which the ownership of a property is changed. The most common form is the purchase and sale of land and house. It also includes transferring part of the ownership of a property, transferring property pursuant to a marriage break up and the gifting of property through a will.
The buyer and seller sign a contract and the parties become bound. The contract often will be subject to a number of conditions which if not met will cause the contract to end and in most circumstances the deposit being refunded to the buyer.
If you are buying a house you will have to carry out a number of inspections prior to the completion of the contract. A special condition would be required in the contract outlining the inspections to be carried out by a certain date. Your conveyancer will arrange these on your behalf. The inspections which are usually recommended by the conveyancer are building or engineering reports, pest/termite inspections, electrical and plumbing.
These inspections are carried out by qualified professionals who provide a written report which is provided to you for consideration prior to the date specified in the contract.
Currently in the NT there is no vendor disclosure. So “Buyer Beware”- it is up to you to make your own enquiries. Do not rely on what the vendor or agent tell you.
First Home Owners Grant
If you have never owned residential property in Australia before, you may be eligible for a First Home Owners Grant to assist you in the purchase of your first home (currently $14,000.00 for existing residences and $21,000.00 for new residences)
To be able to get the grant you must, amongst other things:
- Be over 18 years of age
- By an Australian citizen or permanent resident
- Have never received the grant before;
- Within one year of buying the property, move in and live in the property as your principal place of residence for at least six months.
If your application is successful, you will be paid the grant at the time of settlement of your purchase. If you are obtaining finance to assist with your purchase, the grant may be able to be paid direct to your financier so that your financier can provide you with the additional money on settlement. Ask your financier for more details about payment of the grant.
